This website is operated by Quinta Collective (“Quinta Collective”, “we”, “us”, “our”). We provide this website and all information, tools and services available from it (the “Service”) to you, the user, on the condition that you accept these Terms and Conditions (“Terms”).

By visiting our website, submitting any hire enquiry or booking, or purchasing from us, you agree to be bound by these Terms. If you do not agree, you must not use this website or our Services.

We may update these Terms from time to time by posting a revised version on this page. Your continued use of the website or Services after any changes are posted constitutes acceptance of the updated Terms.


1. CUSTOMER INFORMATION & LEGAL CAPACITY

1.1 You must provide accurate, complete and up-to-date information when submitting any appointment form, dress enquiry form, booking form or making any purchase or hire with us, and you must notify us promptly if your details change. 

1.2 Quinta Collective is not liable for any loss, delay or issue caused by incorrect, incomplete or outdated information supplied by you. 

1.3 By using our Services or requesting a hire, you confirm that you are legally capable of entering into a binding agreement and, if applicable, have consented for any minor dependants to use the site or Services.

1.4 We reserve the right to decline or cancel any booking or order at our reasonable discretion, including where circumstances beyond our control prevent us from fulfilling it.





2. WEBSITE & ONLINE STORE TERMS

2.1 You must not use our products or Services for any unlawful or unauthorised purpose and must comply with all applicable laws (including intellectual property and copyright laws). 

2.2 You must not transmit any malicious code, viruses, worms or anything designed to interfere with or damage the operation of this website, other systems or networks. 

2.3 We may refuse service to anyone, at any time, for any lawful reason. 

2.4 Content you submit through the website (excluding payment card details) may be transferred unencrypted over various networks and adapted to meet technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer. 

2.5 You must not reproduce, duplicate, copy, sell, resell or exploit any part of the Service without our prior written consent. 

2.6 We aim to keep information on the site accurate and current, but do not guarantee that all information is complete, up-to-date or error free. Content is for general information only and should not be relied on as your sole basis for decisions. Any reliance is at your own risk. 

2.7 This website may contain historical information which is not current and is provided for reference only. We may change content at any time without obligation to update specific information. You are responsible for monitoring changes to the site. 

2.8 Prices for our products and Services may change at any time without notice. We may modify, suspend or discontinue any part of the Service at any time and will not be liable for any resulting loss. 

2.9 We make reasonable efforts to display colours and images accurately but cannot guarantee your device’s display is accurate. 

2.11 We may limit sales of products or Services to particular individuals, regions or jurisdictions and may limit quantities per person, per household, or per order. We may also refuse or cancel orders that, in our judgment, appear to be placed by dealers, resellers or distributors. 

2.12 You agree to provide current, complete and accurate purchase and account information, and to update your details (including email and payment card information) so we can complete transactions and contact you as needed. 

2.13 We may provide access to third-party tools and links. These are provided “as is” and “as available”. We do not control or endorse them and are not responsible for their content, accuracy, policies or any loss arising from your use of them. You should review the third party’s terms and policies before engaging in any transaction. 


2.14 If you submit creative ideas, suggestions, reviews, photos, proposals, plans or other materials (“Comments”), you grant us a non-exclusive, royalty-free worldwide licence to use, edit, publish and distribute such Comments in any medium. We have no obligation to keep Comments confidential, pay compensation, or respond. You are solely responsible for any Comments you make. 

2.15 Personal information you submit through the website or online store is governed by our Privacy Policy. 

2.16 The site or Service may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We may correct these and update information or cancel orders where information is inaccurate, including after you have placed an order. 

2.17 In addition to other prohibitions in these Terms, you must not use the website or its content for any unlawful or abusive purpose, to infringe intellectual property rights, to submit false or misleading information, to upload malicious code, to collect or track others’ personal information without consent, to spam or scrape, or to interfere with or bypass security features. We may suspend or terminate your access if you breach this clause. 

2.18 To the fullest extent permitted by law, Quinta Collective is not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, savings, data or replacement costs arising from your use of the website or any product or Service. Where liability cannot be excluded, it will be limited to the maximum extent permitted by law. 

2.19 You agree to indemnify and hold harmless Quinta Collective and its related entities, officers, employees and agents from any claim or demand (including reasonable legal costs) arising out of your breach of these Terms, violation of law, or infringement of any third-party rights.


3. PRIVACY & DATA USE

3.1 Personal information collected by Quinta Collective is used solely for managing and completing your hire and online purchases, and for related communications. 

3.2 We comply with privacy laws including the Privacy Act 1988 (Cth). 

3.3 By proceeding with a booking or purchase, you acknowledge our collection, storage and use of your personal information in accordance with our Privacy Policy.

4. FORMATION OF HIRE AGREEMENT

4.1 These Hire Terms form part of, and are read together with, the Website & Online Store Terms above. 

4.2 A hire booking (“Booking” or “Hire”) is created when: 

(a) you select an available garment and/or accessories (the “Garment”); 

(b) you pay the full Hire Price (and any applicable fees); and 

(c) we confirm your booking by email, text or other written confirmation. 

4.3 Garments cannot be reserved without full payment. Prior to full payment we may hire the Garment to another customer. 

4.4 If any payment fails, is reversed or cancelled, you remain legally liable for the full amount owed, plus any reasonable recovery costs, fees and applicable interest.


5. PRICING, PAYMENTS & AUTHORISATION

5.1 You are responsible for paying the Hire Price, any Dry Cleaning Fee (if applicable), Delivery Fee (if applicable) and any GST. 

5.2 Once the Hire Fee is paid and the booking is confirmed, all bookings are non-refundable except as expressly set out in these Terms. 

5.3 By providing us with your payment details, you authorise Quinta Collective to charge your card for: 

• the Hire Price; 

• Late Fees; 

• damage, repair or replacement costs; and 

• any other amounts payable under these Terms. 

5.4 You must not revoke this payment authority while any amounts remain owing without our written consent.



6. HIRE PERIOD, COLLECTION, RETURN & LATE FEES

6.1 The standard hire period is 4 days, unless otherwise agreed in writing at the time of booking. 

6.2 The Garment must be returned on Day 4 of the hire period (or the next business day if Day 4 falls on a public holiday), or by any other date we agree in writing. 

6.3 For postal hires, Garments must be lodged over the counter at Australia Post using the prepaid Express satchel provided, by the required return date and cut-off time specified in your booking confirmation. Placing returns in street post boxes may result in late fees. 

6.4 The Garment must be returned in the protective cover bag or packaging provided. If this is not returned, a replacement fee may be charged. 

6.5 Late Returns: If you return the Garment after the agreed return date, a late fee of $30 per day (or part day) will apply until the Garment is received back or deemed a non-return. 

6.6 If the Garment is not returned within 14 days of the agreed return date, it may be treated as a non-return, and you may be charged the full replacement value (e.g. RRP) of the Garment in addition to any late fees incurred. 

6.7 If your late return causes us to cancel a subsequent confirmed hire, you may be liable for the full hire amount of the cancelled booking as well as late fees.


7. POSTAL DELIVERY, DISPATCH & DELAYS

7.1 All standard postal hires are shipped via Australia Post Express and include a prepaid Express return satchel. 

7.2 Garments are generally dispatched around 2–5 days before your event date, typically about three days before your booked delivery date. For example, if your event is on a Thursday, your parcel will usually be posted on the Monday prior. 

7.3 If you require earlier dispatch than our standard schedule, you must request this at the time of booking. Early dispatch may require a longer hire period and additional hire fees. 

7.4 Once a parcel has been handed to Australia Post or any delivery agent, delivery times are outside of our control. Quinta Collective is not liable for delays, disruptions or delivery issues caused by postal carriers, including delays due to public holidays. 

7.5 We cannot send items earlier solely because a public holiday falls on or near your hire date. If your usual dispatch day is a public holiday, your parcel will be sent on the next business day. If you require earlier arrival around public holidays or holiday periods, you must book an extended hire period. 

7.6 Delivery timeframes are estimates only. We cannot guarantee exact delivery dates or times. By choosing a postal hire, you accept the risk of potential postal delays. 

7.7 Your responsibility for the Garment begins when it is handed to the delivery provider and ends when it is received back by us. 

7.8 You must comply with all delivery requirements (e.g. ID checks, signatures, collecting parcels) and you consent to us providing your name, address and contact details to the delivery provider for this purpose.


8. GARMENT CONDITION, INSPECTION & CARE

8.1 Garments are hired in gently worn condition and are not brand new. Minor wear consistent with previous hires is to be expected. 

8.2 We guarantee that each Garment will be of adequate quality for the purpose of being worn as clothing. Except as required by law, all other warranties are excluded. 

8.3 Professional dry cleaning after your hire is generally included, unless otherwise specified. However, you are responsible for any excess cleaning or repair costs arising from damage beyond normal wear and tear. 

8.4 You must not clean, dry-clean, wash, iron, steam, alter, repair or otherwise treat the Garment yourself without our written approval. 

8.5 You must inspect the Garment as soon as you receive it. If you notice defects, stains or damage, you must notify us promptly (ideally within 4 hours of collection or delivery) with clear photographs. If we deem the Garment unwearable, we may offer a replacement (subject to availability), store credit, or refund at our discretion. 

8.6 If you do not raise any issue within a reasonable time after receiving the Garment, it will be taken to be in acceptable, hire-ready condition. 

8.7 Damage or Loss: 

- Minor damage (e.g. loose stitching) may incur a repair fee as determined by us in good faith. 

- Major or irreparable damage, or failure to return the Garment, may result in you being charged up to the full replacement value (e.g. RRP) of the Garment. 


8.8 You must treat the Garment with a high level of care due to its delicate and designer nature. You agree to indemnify us for costs, loss or damage arising from your negligence or breach of these Terms.


9. EXCHANGES, FIT ISSUES, CANCELLATIONS & TRANSFERS

9.1 All bookings are non-refundable for change of mind, incorrect sizing or event cancellation, except where we are at fault or as required by law. 

9.2 Within 7 days of making your original booking, you may request to move your booking to a different Garment, subject to availability and any price differences. After 7 days, any change will require a new booking and full payment. 

9.3 If a postal hire is delivered and does not fit, you may request a store credit (less postage costs and any applicable cancellation fee), provided that: 

- you notify us on the same day the parcel is delivered; and 

- the Garment is unworn and returned in original condition and packaging on the same or next business day. 

9.4 If the Garment is returned with signs of wear (e.g. makeup, perfume, odour or visible use), no credit or refund will be provided. 

9.5 If you cancel your booking within 7 days of your event date, the full Hire Price is payable. 

9.6 If Quinta Collective cancels your booking and you are not at fault (for example if the Garment is damaged or not returned by a previous customer), we will offer an alternative Garment where possible or refund the Hire Price you have paid.


10. ALTERATIONS, INTELLECTUAL PROPERTY & PROHIBITED ACTIONS WITH GARMENTS

10.1 You must not alter, tailor, modify, cut, dye or otherwise change any Garment, or allow anyone else to do so, without our prior written consent. 

10.2 You must not copy, reproduce or attempt to recreate the design, pattern or style of any Garment. 

10.3 You acknowledge that Garment designs are the intellectual property of their designers or manufacturers, and you must not infringe the rights of those parties. 


10.4 You indemnify us for any claim made against us arising from your breach of this clause.


11. LIABILITY, RISK & INDEMNITY (HIRE)

11.1 By proceeding with a hire, you acknowledge that Garments may have been worn before and accept normal wear and tear. 

11.2 To the fullest extent permitted by law, we are not liable for any personal injury, loss, damage or consequential loss arising from the wearing or use of any Garment. 

11.3 You agree to indemnify us for all costs, losses, damages and expenses (including legal costs) arising from your breach of this Agreement, including non-return, excessive damage, late return or misuse of a Garment.


12. LATE RETURN RETRIEVAL AUTHORITY

12.1 If you fail to return a Garment on time and do not respond to reasonable contact attempts, you authorise Quinta Collective to attend the address you have provided to request and retrieve the Garment. 

12.2 Any late fees and other charges incurred are payable immediately upon retrieval or on demand.


13. TERMINATION

13.1 We may cancel your booking or suspend/terminate your access to the Service immediately if we reasonably believe you have breached these Terms, provided false or misleading information, or engaged in unlawful or deceptive conduct. 

13.2 You may terminate your use of the website or cancel a booking at any time, subject to the cancellation and refund rules in these Terms. 

13.3 Any obligations incurred prior to termination (including payment obligations and indemnities) will survive termination.


14. DISPUTE RESOLUTION

14.1 Both parties agree to attempt to resolve disputes through good-faith negotiation first. 


14.2 If a dispute cannot be resolved within a reasonable time, either party may refer the matter to independent mediation. If the parties cannot agree on a mediator, either party may ask the President of the Law Society of Western Australia to appoint one.

14.3 Except for urgent injunctive relief, neither party will commence court proceedings until the negotiation and mediation steps above have been attempted.


15. SEVERABILITY, WAIVER & ENTIRE AGREEMENT

15.1 If any part of these Terms is held to be unlawful, void or unenforceable, that part will be severed and the remainder will continue in full force. 

15.2 A delay or failure by us to enforce any right or provision does not constitute a waiver of that right or provision. 

15.3 These Terms, together with any policies and notices on our website, form the entire agreement between you and Quinta Collective regarding your use of the website and our hire and retail Services, and supersede any prior agreements or understandings.


16. VARIATIONS TO TERMS

16.1 Quinta Collective may update or modify these Terms at any time by posting changes on our website. 

16.2 Changes apply to future bookings and use of the website. It is your responsibility to check this page periodically. 

16.3 Your continued use of the website or Services after changes are posted constitutes your acceptance of the updated Terms.


17. GOVERNING LAW

17.1 These Terms and any separate agreements under which we provide you with Services are governed by the laws of Western Australia. 

17.2 You submit to the non-exclusive jurisdiction of the courts of Western Australia and any courts that may hear appeals from those courts.




18. DEFINITIONS

Booking / Hire means a confirmed arrangement where full payment of the Hire Price has been made. 

Delivery Address means the address you provide for delivery of the Garment. 

Delivery Agent means Australia Post or any other carrier we select. 

Garment means any clothing or accessory hired from Quinta Collective under a Booking. 

Hire Price / Hire Fee means the total amount payable to hire the Garment, including any deposits and remaining balances. 

Service means the website, online store, and any hire or retail services provided by Quinta Collective. 

You / Your / Customer means the person using the website, making a purchase, submitting a booking or hiring a Garment from Quinta Collective.
